dangers of sextingIt is a bad idea to send compromising pictures and text messages to anyone. This post doesn’t provide enough space to list ALL the reason NOT to do it. If common sense and seemingly endless anecdotal evidence aren’t enough to convince you not to engage in the incredibly short-sighted and ill-advised activity of “sexting”, then perhaps a quick review of relevant law and legal ramifications will do the trick.

Harmless or Harmful?

One of the most common scenarios involves the distribution of nude or revealing pictures, previously sent back and forth as private “sexts” between romantic partners, but now made public by one of the parties after the dissolution of the relationship. In addition to the embarrassment and humiliation of the exposed ex, the sender of the explicit content can now end up in hot water, because sharing someone’s sexually explicit photos and videos without their permission is now punishable in some states that have criminalized “revenge porn”.

Legal Ramifications

But we don’t need to go looking at new laws to see that disseminating this material is a poor decision. There are plenty of laws already on the books that can be and are used to punish the unwanted or unlicensed distribution of sext messages, such as civil suits for invasion of privacy and intentional infliction of emotional distress, and criminal charges of harassment, stalking, or even disseminating child pornography, depending on the age of the person in the picture.

Hit Send and It’s Out of Your Control

The bottom line is that once you grant someone access to that material, by sending it to them or posting it on the internet, you give up control over who gets access to it. It’s like putting it in an envelope and sending it away – how can you prevent them from showing it to others, or from photocopying it and plastering it all over town? The only way to be sure that personal information isn’t being disseminated to the entire world is to abstain from granting anyone access to it in the first place.
